1. Acceptance of Terms

By accessing or using Yardcast ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Yardcast provides AI-powered landscape design generation through our website and mobile app. You upload photos of your outdoor space, mark the area you want improved, answer questions about your preferences, and receive AI-generated design concepts with plant and project guidance.

3. Important Disclaimers

• Consult licensed landscape architects, contractors, engineers, or irrigation professionals when your project requires professional review
• Verify plant selections with local nurseries for your specific conditions, including hardiness zone, sun exposure, soil, water needs, and invasive-species restrictions
• Check local regulations, utility locations, drainage, slope safety, setbacks, permits, and HOA rules before landscaping
• Cost estimates are approximations and may vary significantly
• AI-generated images may contain visual errors, including imperfect plant identification, scale, bed edges, or preservation details, and should be reviewed before making purchasing, construction, or planting decisions

4. User Responsibilities

You agree to:

• Upload only photos you have the right to use
• Not upload illegal, harmful, or inappropriate content
• Provide accurate information about your project
• Not attempt to reverse-engineer or abuse the Service
• Not resell or redistribute designs without permission

5. Intellectual Property

Your Photos: You retain ownership of photos you upload. By uploading, you grant Yardcast a license to process them for design generation.

Generated Designs: Upon purchase, you receive a license to use the generated designs for personal or commercial landscaping purposes, including showing them to your own clients on a contractor plan. You may not resell the designs themselves.

6. Prices, Payment and Refunds

• No free designs. Every design is part of a paid Design Pack or a paid plan.
• Design Pack: $29.99, paid once on our website through Stripe. It covers one design of your photo in both bed options (keep your bed's shape, or a new bed) plus one free redo with your change notes. It is not a subscription.
• Quality check: if a design does not pass our quality check, it is held back, it is not shown to you, and it does not use up your Design Pack or plan allowance.
• YardCast Plus (iPhone app): an auto-renewing subscription at $39.99 per month or $299.99 per year, billed by Apple to your Apple ID and managed with RevenueCat. It includes 4 Design Packs each month; unused packs do not roll over. It renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it in your Apple ID subscription settings. Apple's terms and refund rules apply to App Store purchases.
• Contractor plans: Pro ($79 per month, 20 designs a month) and Crew ($199 per month, 60 designs a month, up to 5 team logins) are monthly subscriptions billed by Stripe on our website. Extra designs past the monthly limit cost $3 each. Unused designs do not roll over. You can cancel anytime from your billing page; cancellation takes effect at the end of the current billing period.
• All prices are in US dollars unless the App Store or checkout shows otherwise. We may change prices for future purchases or billing periods; a change never affects a period you have already paid for.
• If a paid design fails because of a service, provider or quality issue, we may retry it, restore your allowance, or resolve it through support.
• Refund requests go to trent@reviveflow.ai. Refunds for App Store purchases are handled by Apple.

7. Acceptable Use and Photo Rights

• Do not upload photos you do not have permission to use
• Do not upload photos containing sensitive personal information that is not needed for the landscape request
• Do not use Yardcast to create misleading, illegal, harassing, discriminatory, or unsafe content
• Do not attempt to bypass usage limits, payment controls, security controls, or provider restrictions

8. Limitation of Liability

Yardcast is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to landscaping decisions made based on our designs. Our maximum liability is limited to the amount you paid for the Service.

9. Termination

We reserve the right to terminate or suspend your access to the Service at any time for violation of these terms or for any other reason at our discretion.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. Material changes will be communicated via email or notice on the website.

11. Governing Law

These terms are governed by the laws of the State of Florida, United States. Any disputes will be resolved in the courts of Miami-Dade County, Florida.
